Valletta requesting a Written <br /> Finding under Article V §174-17 of the Zoning By-laws and M.G.L. Chapter 40A §6 <br /> concerning continuance,extension or alteration of a pre-existing,non-confonning structure <br /> to allow for construction of a spiral staircase to access second story deck on property <br /> located in an R-3 Zoning District at 112 Captains Row(Map 96 Parcel 17),Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on June 6, 2014 and June 13, 2014 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 25, 2014 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush,Vice Chairman,William Blaisdell, Clerk,Ron <br /> Bonvie, Board Member Richard Jodka, and Associate Member, Domingo DeBarros. Also <br /> present was Building Commissioner, Mr. Richard Morgan. <br /> Mr. Edward Shea, of Shea Custom Carpentry, Inc. represented the applicant Mr. <br /> Robert Valetta. He presented a plot plan depicting the pre-existing structure requesting to <br /> construct a second story master suite and a spiral stair case as a means of access from the <br /> rear deck. Mr. Shea stated that he spoke with Drew McManus, in Conservation who does <br /> not have a problem with the project. The homeowner has a pre-approved patio from a <br /> previous variance request and an NOI that was also approved. <br /> Mr. Furbush wants the shed removed and will condition this into the decision. Mr. <br /> Shea said he is not moving closer to the side line and the lot coverage will be less than the <br /> 16.3%. <br /> 1 <br />
