Purpose and Intent <br />1. This section promotes the creation of new small, medium and large-scale, ground-mounted solar energy <br />systems overlay district, in the areas which are delineated on a map dated January 25, 2021 and entitled <br />"Solar Energy Systems Overlay District, ROUTE 151, ALGONQUIN AVENUE AND OLD <br />BARNSTABLE ROAD, Mashpee, Massachusetts," (attached hereto) and which shall be considered as <br />superimposed over other districts established by the zoning by-laws of the Town. This map, as it may be <br />amended from time to time, is on file with the office of the Town Clerk and with any explanatory material <br />therein, is hereby made a part of this chapter, by providing standards for the placement, design, construction, <br />operation, monitoring, modification and removal of such installations that address public safety, minimize <br />impacts on scenic, natural and historic resources and for providing adequate financial assurance for the <br />eventual decommissioning of such installations. This Overlay District Ordinance is adopted pursuant to the <br />Commonwealth of Massachusetts Green Communities Act and Massachusetts General Laws Chapter 40A <br />Section 3. <br />2. Uses, other than Solar Energy Systems, otherwise not permitted in the portions of a zoning district <br />superimposed by this district shall not be permitted in this district. <br />3. The Solar Energy Systems Overlay District shall include all of the land within the lines described in <br />subsection B, which are in the R-5 and C-2 zoning districts.
