Moskowitz Land Court Lot#: 52 <br /> 146 Popponesset Island Road Plan#: 11408-12 <br /> (Map 112 Parcel 10) <br /> Mashpee, MA 02649 <br /> A Petition was filed on July 21,2014 by Michael Moskowitz requesting a Variance <br /> under §174-31 (Land Space Requirements) of the Zoning By-laws and M.G. L. Chapter <br /> 40A §10 for relief from the front yard and lot coverage requirements to allow for <br /> construction of a 528 sq. ft. addition on the Southerly side of the dwelling and to add some <br /> additional living space above the existing garage on property located in an R-3 Zoning <br /> District at 146 Popponesset Island Road, (Map 112 Parcel 10), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on August 8, 2014 and August 15, 2014 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 27, 2014 at which time the following members of the Board of <br /> Appeals were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, <br /> Board Members,James Reiffarth,Richard Jodka,and Associate Members,Dom DeBarros, <br /> and Scott Goldstein. Also present was Building Commissioner, Michael Mendoza. <br /> Attorney, Kevin Kirrane represented the Petitioner, Mr. Moskowitz regarding a <br /> variance at 146 Popponesset Island Road. The variance relief application is due to the <br /> proximity of the dwelling to the street. The proposal includes enclosing the porch for a <br /> living area,bedroom, and exercise room above. There is a slight increase over the 20% lot <br /> coverage requirement. Mr. Kirrane provided the Board with a narrative, photos, and plot <br /> plan that highlights the existing structure. The proposal includes additional living space <br /> above the garage, (not increasing the footprint of the building), and a 528 square foot <br /> addition on the Southerly side. <br /> 1 <br />
