L. Chapter <br /> 40A §10 for relief from the front, rear and side setback requirements of a residential <br /> structure located in a C2 Zone at 36 Savannas Path, (Map 62 Parcel 68B), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on August 8, 2014 and August 15, 2014 a <br /> copy of which is attached hereto and made a part hereof. <br /> This Petition was continued from August 27, 2014. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 10, 2014 at which time the following members of the Board of <br /> Appeals were present and acting throughout;Chairman,Jonathan Furbush,Vice Chairman, <br /> William A. Blaisdell, Cleric, Ronald Bonvie, Board Member, James Reiffarth and <br /> Associate Members Dom DeBarros and Scott Goldstein. Also present was Building <br /> Commissioner, Michael Mendoza. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Attorney, Kevin Kirrane, represented Cotuit Solar, LLC, who applied for a <br /> Variance relief to construct a warehouse and renovate an existing two story building for a <br /> solar energy business. The solar energy business will be utilizing the existing building for <br /> office and warehouse building for storage. The customer business will be conducted off- <br /> site at their customer locations. <br /> The request for variance relief is 75-feet from the front yard setback and 50 feet <br /> from the rear yard setback because the property abuts a residential zone located to the West <br /> of the subject property. <br /> 1 <br />
