Chapter 40A §6 concerning <br />continuance, extension or alteration of a pre-existing, non -conforming structure to raze and <br />replace a single-family dwelling located on property in an R-3 Zoning District at 27 Elliot <br />Road, (Map 118 Parcel 118), Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General Laws <br />Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br />general circulation in the Town of Mashpee, on September 19, 2014 and September 26, <br />2014 a copy of which is attached hereto and made a part hereof. <br />Public Hearings were held on Wednesday, October 8, 2014 on this Petition at the <br />Mashpee Town Hall at which time the following Board members were present; Jonathan <br />Furbush, Chairman, William A. Blaisdell, Vice Chairman, Ronald Bonvie, Clerk, Board <br />Member, James Reiffarth, Associate Members, Dom DeBarros and Scott Goldstein. Also <br />present was Building Commissioner, Michael Mendoza. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provision of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br />Zoning By-laws. <br />Attorney, Marl-, Gildea represented the Petitioner requesting to raze and replace and <br />existing single-family home. Also present was Raul Lizardi-Rivera, of Holmes and <br />McGrath, Engineering and Joe Colantano, Builder for the project. Mr. Gildea provided <br />pictures of similar homes in the neighborhood, proposed house plans, and a plot plan <br />depicting the existing and proposed dwelling with a covered porch. <br />The property is located in the Popponesset Overlay District and is just under 8,400 <br />square feet, with a concrete patio and paved driveway. There is sufficient parking and has <br />no setback issues. The existing setback in the front is 19.5 under the proposal and will <br />increase to 20 feet. Conservation has approved the project and awarded an order of <br />conditions. The applicant is proposing a modest home and has no issues with lot coverage <br />within the required 20%. <br />
