MASHPEE ZONING BOARD OF APPEALS
DECISION FOR A SPECIAL PERMIT
Accidental Auto Body, Inc.
89 Industrial Drive (Map 88 Parcel 27)
(Owner of Record: Robert A. Lawton)
Mashpee, MA 02649
SP-2014-51
The proposed building will have four (4) bays, with fifty five (55) parking spaces
and four (4)handicapped spaces. The building will meet the required setbacks and will be
74 feet setback from the rear property line.
Attorney Gildea stated the Board of Health requires a tight tank for any discharge
in the building. The spray booth is an enclosed building within a building, and will be
located in the rear venting out toward the North as per Board of Health. The products used
in the spray booth are waterborne, and the applicant is required to comply with all EPA
regulations with a 98% efficiency rating. Matt Dennison stated the majority of the paint is
waterborne. Floor and spray filters should be changed a minimum of twice a year. Auto
businesses should have a"filtration change-out program"and are generally scheduled with
filter companies regulated by the EPA.
Mr. Blaisdell read an email dated October 22, 2014 from Joel Clifford, Fire
Inspector,Mashpee Fire Department supplied to Raul Lizardi-Rivera,P.E.,into the record,
"The turning radius template appears to be adequate. "
Mr. Blaisdell read an email dated November 10, 2014, from Michael Mendoza,
Building Commissioner into the record listing the following:
• No outside storage of tires, auto parts, and things of that nature; and there should
be no dripping of oil; gasoline; etc. The site should maintain the appearance of a
clean well run facility.
• The installation of a 6'high, solid fence is to be marked on Plan and installed to
protect abutters.
• Project falls under Control Construction-Building Code Requirement.
• Handicapped parldng sign to be installed on post per code.
Mr. Blaisdell read a letter dated October 21,2014, from the Mashpee Water District
into the record; `I have been asked to put my opinion in writing regarding the property (89
Industrial Drive) adjacent to the Water District property at 79 Industrial Drive. Currently
pavement for both properties meets at the property line with no separation. We have no
objection to the owner of 89 Industrial Drive locating parking spaces at the property line.
Additionally, we do not object to pavement with no separation.. Our continued acceptance
of waiver of zoning laws would be contingent on the property owner at 89 Industrial Drive
to allow vehicles access to Water District parldng areas. If you have any questions or
concerns, please feel free to contact me. " "Truly, Andrew Marks, Operation Manager,
Mashpee Water District at 79 Industrial Drive, Mashpee, MA.
