Sahl and Lois S. Sahl
requesting a Variance under §174-31 of the Zoning By-laws to allow for construction of
an addition and garage onto a dwelling on property located in an R-3 zoning district at 7
Chicory Circle (Map 89 Parcel 28) Mashpee, MA.
Notice was duly given to abutters in accordance with Massachusetts General
Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a
newspaper of general circulation in the Town of Mashpee, on January 4, 2013 and
January 11, 2013, a copy of which is attached hereto and made a part hereof.
On February 13, 2013, Public Hearings were held on the Petition at the Mashpee
Town Hall. The following members of the Board were present: Jonathan D. Furbush,
William A. Blaisdell, Ronald S. Bonvie, James Reiffarth, and Associates Members John
M. Dorsey and Domingo K. DeBarros.
At the request of the Petitioner's attorney, this Petition was continued from
January 23, 2013 Public Hearing to allow for a full Board to be present and sitting.
Attorney Kevin Kirrane represented the Petition and stated that plans call for
construction of a bedroom addition consisting of 432 square feet to the rear of the
existing garage. Construction of the proposed addition on the left hand side of the rear of
the dwelling will encroach into the North East corner within 7.4 feet of the property line.
The subject property is in a cluster sub-division; lot coverage is 30%, front setback is 30,
rear set back 20, side setback is 15.
Attorney Kirrane suggest that Variance relief be granted without substantial
detriment to the neighborhood. He submitted a copy of a letter from the President of the
Green Wood Homeowner's Association indicating their support of the proposal and a
copy of a letter from the abutters, Michele & Ryan Staats and Rosemary Tuohey, who
indicated they have no objection to the proposal.
1
