a <br />s <br />Town ofl)fashpee <br />M Creat ,)\reek Road oNtorth <br />. w McLglipee, Wassachusetts 036.19 <br />MASHPEE ZONING BOARD OF APPEALS <br />JANUARY 9, 2013 <br />MINUTES <br />The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, <br />January 9, 2013, at 6:00 p.m. in Conference Room #1 at the Mashpee Town Hall, 16 <br />Great Neck Road North. Board Members Jonathan D. Furbush, Ronald S. Bonvie, <br />James Reiffarth and Judith M. Horton, and Associate Member Domingo K. <br />DeBarros were present. Board Member William A. Blaisdell, Associate Member <br />John M. Dorsey, and Building Commissioner Richard E. Morgan were unable to <br />attend. <br />Chairman Jonathan D. Furbush opened the meeting at 6:00 p.m. and announced that <br />the meeting was being televised live on local Mashpee television. <br />PLEDGE OF ALLEGIANCE <br />Mr. Furbush said that the Board will hear the Petitioner's presentation; then the <br />Board will have an opportunity to ask questions; any new correspondence will be <br />read into the record; finally, the discussion will be opened for public comment. He <br />said that the Board is interested in hearing anything new concerning the continued <br />• Petitions. <br />Mr. Furbush announced that the four Board Members and Associate Member would <br />be sitting on the Petitions. Unable to attend the December 12, 2012 ZBA Public <br />Hearings, Board Members James Reiffarth and Judith M. Horton submitted written <br />certification that they examined evidence received at the missed session. This <br />written certification complies with Article 21 of Chapter 39 of the General Laws <br />§23D and shall become part of the record of this hearing. <br />CONTINUED HEARINGS <br />Nicholas S. and Ann K. Mabardv: Request a Written Finding under §174-17 of the <br />Zoning By-laws and M.G.L. Chapter 40A §6 concerning continuance, extension or <br />alteration of non -conforming structures to allow for construction of a single-family <br />dwelling on property located in an R-3 zoning district at 2 Rock Island Road (Map <br />123 Parcel 17) Mashpee, MA. Continued from December 12, 2012: Board requested <br />Town Counsel opinion concerning proposed 31 % lot coverage. <br />Sitting: Board Members Jonathan D. Furbush, Ronald S. Bonvie, James Reiffarth <br />and Judith M. Horton, and Associate Member Domingo K. DeBarros <br />Nicholas S. and Ann K. Mabardv: Request a Special Permit under §174-20 of the <br />• Zoning By-laws concerning rebuilding of destroyed or damaged non -conforming <br />structures to allow for construction of a single-family dwelling on property located in <br />an R-3 zoning district at 2 Rock Island Road (Map 123 Parcel 17) Mashpee, MA. <br />Continued from December 12, 2012: Board requested Town Counsel opinion <br />concerning proposed 31% lot coverage. <br />
