Tommasino and Deborah <br /> D. Thornton requesting a Written Finding under §174-17 of the Zoning By-laws and <br /> M.G.L. Chapter 40A Section 6§ concerning continuance, extension or alteration of pre- <br /> existing, non-conforming structures to allow for construction of additions onto a dwelling <br /> on property located in an R-3 zoning district at 196 Waterway (Map 111 Parcel 96) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on January 25, 2013 and <br /> February 1, 2013, a copy of which is attached hereto and made a part hereof. <br /> On February 13, 2013, Public Hearings were held on the Petition at the Mashpee <br /> Town Hall at which time the following members of the Board were present and acting <br /> throughout: Board Members Jonathan D. Furbush, William A. Blaisdell, Ronald S. <br /> Bonvie, James Reiffarth, Associate Member, John M. Dorsey and Domingo K. DeBarros. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Attorney Kevin Kirrane represents the Petition which consists of a small - <br /> alteration of the rear existing deck to accommodate a master bedroom suite, a front entry <br /> ramp, and a small half-bath on the first floor level. Also proposed is the removal of a <br /> spiral stair case from the basement to accommodate the installation of a handicap <br /> accessible bathroom. <br /> An interoffice memo, dated February 12, 2013 from Veronica Warden, Asst. <br /> Health Agent (196 Waterway) in Zone II. The dwelling is restricted to two bedrooms; the <br /> proposed additions and one additional bedroom.
