Borchardt, Zoning <br /> Manager, of SBA Properties, Inc. 5900 Broken Sound Parkway NW, Boca Raton, FL <br /> 33487. Requests Extension of Special Permit SP-97-70 to allow for an existing radio <br /> telecommunications facility and associated equipment permitted under §§174-25.B(6), <br /> 174-25.1)(5) and 174-25.H(6) of the Zoning By-laws on property located in an I-1 zoning <br /> district at 154 Industrial Drive (Map 88 Parcel 31) Mashpee, MA. This request is in <br /> compliance with conditions of the 1997 ZBA Decision, which expires on March 23, <br /> 2013. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws, Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on January 25, 2013 and <br /> February 1, 2013, a copy of which is attached hereto and made a part hereof. <br /> On February 13, 2013, Public Hearings were held on the Petition at the Mashpee <br /> Town Hall at which time the following members of the Board were present and acting <br /> throughout: Board Members Jonathan D. Furbush, William A. Blaisdell, Ronald S. <br /> Bonvie, James Reiffarth, Associate Member, John M. Dorsey and Domingo K. DeBarros. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Attorney Park Sheffield represented SBA Communications Towers, the owner of <br /> the 250 ft tower located at 154 Industrial Drive, Mashpee, MA. Attorney.Sheffield <br /> recommended that the Board, require the Petitioner to post a removal bond of$25,000 to <br /> the Town of Mashpee for fifteen (15) years to cover costs for the removal of the facility if <br /> necessary. <br /> 1 <br />
