L. Chapter 40A Section §6 concerning continuance, extension or alteration <br /> of pre-existing, non-conforming structures to allow for construction of a new <br /> dwelling on property located in an R-3 Zoning District at 36 Jackbon Road (Map <br /> 90 Parcel 36) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The Mashpee <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, on <br /> February 8, 2013 and February 15, 2013, a copy of which is attached hereto and <br /> made a part hereof. <br /> On February 27, 2013, Public Hearings were held on the Petition at the <br /> Mashpee Town Hall at which time the following members of the Board were <br /> present and acting throughout: Board Members Jonathan D. Furbush, William A. <br /> Blaisdell, James Reiffarth and Judith Horton, Associate Member, John M. <br /> Dorsey. Building Commissioner Richard E. Morgan was also present. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to <br /> the provision of Massachusetts General Laws Chapter 40A §9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Michael Monahan presented the Petition which consists of raising the <br /> existing non-conforming structure, removing all debris, all concrete, a screened <br /> patio, gazebo, and a shed at the rear,Northern side of the lot. <br /> 1 <br />
