Cusick, Jr. & Dorie <br /> Ann Krawiec for a Written Finding under §174-17 of the Zoning By-laws and M.G. L. <br /> Chapter 40A §6 concerning continuance, extension or alteration of pre-existing, non- <br /> conforming structures to allow for construction of a new dwelling on property located in <br /> an R-3 Zoning District at 12 Pine Avenue, (Map 123 Parcel 38), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on April 5, 2013 and April 12, <br /> 2013, a copy of which is attached hereto and made a part hereof. <br /> On April 24, 2013, Public Hearings were held on the Petition at the Mashpee <br /> Town Hall at which time the following members of the Board were present and acting <br /> throughout: Board Members Jonathan D. Furbush, William A Blaisdell, Ronald S. <br /> Bonvie, James Reiffarth, Judith Horton, Associate Members, John M. Dorsey, and <br /> Domingo K. DeBarros. Also present was Richard E. Morgan, Building Commissioner. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provision of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. William R. Cusick, representing himself and his wife Dorie Ann Krawiec <br /> presented the Petition which consists of razing the existing non-conforming structure and <br /> deck that consists of 1,437 square feet and replacing it with a 2.5 story dwelling, with a <br /> new foundation consisting of 1,489 square feet. The proposed new foundation will <br /> consist of 30 feet by 48 feet, and does not include a deck. He indicated he is also looking <br /> for relief of 10 foot side setbacks on both sides. <br /> 1 <br />
