MASHPEE ZONING BOARD OF APPEALS William R. Cusick, Jr. & Doric Ann Krawiec 12 Pine Avenue (Map 123 Parcel 38) FINDING-2013-09 Specific Written Findings: The Board determined that the proposal shall not be substantially more detrimental than the existing non-conforming structure or use to the neighborhood, as defined under Section 174-17 of the Zoning By-laws,because of the following: • Is compliant with the specific dimensional requirements as indicated in the proposal of the 20% lot coverage and average grade of 23 feet. • Has adequate parking upon removing the garage and installing cleaned crushed stone material. • Board of Health approval as noted by the Assistant Health Agent, that the property is in Zone II and restricted to a three(3)bedroom dwelling. In view of the foregoing, the Board determined that the Petitioner met the criteria for a Written Finding. Upon motion duly made and seconded at the Public Hearing on April 24, 2013, the Zoning Board of Appeals voted unanimously to grant a Written Finding to allow for the proposal. This Decision is contingent upon compliance with plot plans that refer to this project drafted by BSS Design Engineering & Surveying of the proposed, prepared for Doric Krawiec & William Cusick, 12 Pine Avenue, Mashpee, MA, Scale 1" = 20' dated, March 20, 2013, drawn EJP, TJB,job number 12086, drawing number P20-49A, signed by Thomas Jackson Bunker, registered professional land surveyor. Also this is based upon the foundation and framing plan dated March 25, 2013,by Amy Nastasi, Registered Architect, 1341 Massachusetts Avenue, Lexington, MA 02420 for project: Krawiec/Cusick Residence, 12 Pine Avenue, Mashpee, MA, stamped by the Mashpee Board of Health on March 27, 2013. 3
