L. <br /> Chapter 40A §10 for relief from the front, rear and side setback requirements of a <br /> residential structure located in a C2 Zone at 36 Savannas Path, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on May 3, 2013 and May 10, <br /> 2013, a copy of which is attached hereto and made a part hereof. <br /> On May 22, 2013 Public Hearings were held on the Petition at the Mashpee Town <br /> Hall at which time the following members were present and acting throughout: Board <br /> Members Jonathan D. Furbush, William A. Blaisdell, James Reiffarth, Judith Horton, and <br /> Associate Members John Dorsey and Domingo K. DeBarros. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Attorney, Michael Koretz, represented Cotuit Solar, LLC and Conrad Geyser, <br /> Principal of Cotuit Solar, Joseph Hackler, and Michael Aucoin, Engineer. Mr. Koretz <br /> stated that 36 Savannas Path was formerly in an R-5 residential zone, and was changed to <br /> a C-2 zone at Town Meeting, in May 2010. The current dwelling was used as a residence <br /> and was foreclosed on when Mr. Geyser bought the property in February, 2012. He stated <br /> Mr. Geyser is proposing to develop the parcel and manage his solar energy business at <br /> the existing dwelling. Mr. Geyser is also looking to construct a pole barn for storage of <br /> his equipment and products. <br /> Michael Aucoin, Engineer for Cotuit Solar stated the property borders two <br /> commercial properties off Trinity Place. He stated their idea is to extend Trinity Place to <br /> Savannas Path and acquire the adequate frontage and access for the fire department. They <br /> are proposing to connect Trinity Place and Savannas Path, and keep the dirt road open. <br /> 1 <br />
