Gennaco Certificate of Title#199708 <br /> 46 Kim Path Land Court# 6 (Block E) <br /> Mashpee, MA 02649 Plan#: 11408-H (Sheet 1) <br /> A Petition was filed on May 14, 2013 Joseph P. and Jean E. Gennaco <br /> requesting a Written Finding under Section 174-20 of the Zoning By-laws <br /> concerning rebuilding of destroyed or damaged non-conforming structures to <br /> allow for rebuilding of a single-family dwelling on property located in an R-3 <br /> Zoning District at 46 Kim Path(Map 117 Parcel 94). <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The Mashpee <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, on May <br /> 24, 2013 and May 31, 2013 a copy of which is attached hereto and made a part <br /> hereof. <br /> On June 12, 2013 Public Hearings were held on this Petition at the <br /> Mashpee Town Hall at which time the following Board members were present, <br /> Jonathan D. Furbush, William A. Blaisdell, Ronald S. Bonvie James Reiffarth, <br /> John Dorsey, Associate Members, Domingo K. DeBarros, and Richard Jodka and <br /> Building Commissioner, Richard Morgan. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to <br /> the provision of Massachusetts General Laws Chapter 40A §9 and the Town of <br /> Mashpee Zoning By-laws. <br /> At the request of the Board members, this Petition was continued to June <br /> 26, 2013 because official septic plans were not formally submitted to the Board of <br /> Health. At this Public Hearing, the following Board Members were present, <br /> Jonathan D. Furbush, William A. Blaisdell, Ronald S. Bonvie, Judith Horton, and <br /> John Dorsey. Also present Associate Members, Dom DeBarros and Richard Jodka <br /> and Building Commissioner, Richard Morgan. <br /> Attorney Kevin Kirrane represented the Petitioners requesting to raze and <br /> replace a pre-existing non-conforming structure located in the Popponesset <br /> Overlay District which has established lot requirements. Mr. Kirrane submitted <br /> revised architectural, septic, and site plans to the Board depicting the proposed <br /> two bedroom dwelling. The site plan shows a slight non-conformity on the <br /> Northwesterly side lot line decreasing from 8.5 feet to 9 feet. As advised by the <br /> consulting engineer, the frontage requires 26 feet as oppose to the required 25 feet <br /> to accommodate the proposed septic location. <br /> R�G� <br />
