Reardon Book#34 Page 82 <br /> 36 Nick Trail Lot 4 (Block 7) Plan I I408H <br /> Mashpee, MA 02649 <br /> A Petition was filed on May 29, 2013 for Michael W. Reardon and Claire <br /> M. Reardon requesting a Written Finding under Section 174-17 of the Zoning By- <br /> laws and M.G.L. Chapter 40A §6 concerning continuance, extension or alteration <br /> of a pre-existing, non-conforming structure to allow for construction of a new <br /> addition on property located in an R-3 Zoning District at 36 Nick Trail (Map 117 <br /> Parcel 299), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The Mashpee <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, on June 7, <br /> 2013 and June 14, 2013 a copy of which is attached hereto and made a part <br /> hereof. <br /> On June 26, 2013 Public Hearings were held on this Petition at the <br /> Mashpee Town Hall at which time the following Board members were present, <br /> Jonathan D. Furbush, William A. Blaisdell, Ronald S. Bonvie, Judith Horton, <br /> John Dorsey, and Associate Members, Domingo K. DeBarros, and Richard Jodka. <br /> Also present was Richard Morgan, Building Commissioner. Board Member <br /> James Reiffarth was absent. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to <br /> the provision of Massachusetts General Laws Chapter 40A §9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Steven Cook, owner of Cotuit Bay and Design, represented the <br /> petitioner. Mr. Reardon, homeowner was also present. Mr. Cook stated the <br /> petitioner is proposing to convert an existing storage area within 11.7 feet of the <br /> rear property line to expand the kitchen. <br /> 1 <br />
