Leccese and William Ferrer Certificate of Title#199061 <br /> 44 Barbary Circle Land Court Lot 97 <br /> Mashpee, MA 02649 Plan#22111-B <br /> A Petition was filed on May 29, 2013 for Diane M. Leccese and William <br /> Ferrer requesting a Special Permit under Section 174-33 of the Zoning By-laws <br /> and M.G.L. Chapter 131 §40 concerning any building or structure, exclusive of <br /> fixed or floating piers, wharves, docks, bridges or boardwalks, shall be set back at <br /> least fifty (50) feet from any water or wetland to allow for construction of a new <br /> addition and deck on property located in an R-3 Zoning District at 44 Barbary <br /> Circle, (Map 96 Parcel 104G), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The Mashpee <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, on June 7, <br /> 2013 and June 14, 2013 a copy of which is attached hereto and made a part <br /> hereof. <br /> On June 26, 2013 Public Hearings were held on this Petition at the <br /> Mashpee Town Hall at which time the following Board members were present, <br /> Jonathan D. Furbush, William A. Blaisdell, Ronald S. Bonvie, Judith Horton, <br /> John Dorsey, and Associate Members, Domingo K. DeBarros, and Richard Jodka. <br /> Also present was Richard Morgan, Building Commissioner. Board Member <br /> James Reiffarth was absent. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to <br /> the provision of Massachusetts General Laws Chapter 40A §9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Steven Cook, owner of Cotuit Bay and Design, LLC, represented the <br /> petitioners. Mr. Ferner, homeowner was also present. The proposal is to construct <br /> a new family room 11 feet by 30 feet on the same foot print and add an 8 foot by <br /> 20 foot deck with stairs heading down to the Mashpee River. Both the addition <br /> and the proposed deck are within the 50 foot buffer from the top to coastal bank. <br /> 1 <br />
