Chapter 40A §6 concerning continuance, extension or alteration of a pre-existing, non-conforming structure to construct a small addition and detached boathouse with two bedrooms on property in an R-3 Zoning District at 65 Seconsett Point Road (Map 124 Parcel 14-0-R) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on July 5, 2013 and July 12, 2013 a copy of which is attached hereto and made a part hereof. On July 24, 2013, Public Hearings were held on this Petition at the Mashpee Town Hall at which time the following Board members were present, Board Members Jonathan D. Furbush, William A. Blaisdell, James Reiffarth, Ronald S. Bonvie, John M. Dorsey and Associate Members Domingo K. DeBarros and Richard J. Jodka were present. Building Commissioner Richard E. Morgan was also present. On July 24, 2013, Public Hearings, this hearing was continued to Wednesday, August 14, 2013 due to safety concern questions and setbacks in this neighborhood. The police and fire departments apparatus need to maneuver on this road. Also, the Board requested the existing and proposed elevations and updated floor plans. On August 14, 2013,Public Hearings,this hearing was continued to September 11, 2013, due to the Board suggesting the applicant re-file under Section 174-33, concerning setbacks from the water and wetlands. Attorney Brian Wall, representing the applicant submitted a letter dated August 15, 2013 requesting an extension until the Public Hearings dated September 11, 2013. On August 28, 2013, Public Hearings, the Board voted to accept the applicant's letter of extension and is attached to this Decision. 1
