Chapter <br /> 40A §6 concerning continuance, extension or alteration of a pre-existing, non- <br /> conforming structure to allow for construction of an addition on property located <br /> in an R-3 Zoning District at 148 Whippoorwill Circle (Map 125 Parcel 143), <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The Mashpee <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, on July 26, <br /> 2013 and August 2,2013 a copy of which is attached hereto and made a part hereof. <br /> On August 14, 2013, Public Hearings were held on this Petition at the <br /> Mashpee Town Hall at which time the following Board members were present, <br /> Jonathan D.Furbush,William A.Blaisdell,James Reiffarth,Ronald S. Bonvie, and <br /> Associate Members, Domingo K. DeBarros, and Richard Jodka. Also present was <br /> Richard Morgan, Building Commissioner. Board Member John M. Dorsey was <br /> absent. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provision of Massachusetts General Laws Chapter 40A §9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Michael Borselli, Falmouth Engineering represented the petitioner who is <br /> requesting an interior master bedroom renovation with an expanded closet and <br /> ADA approved bathroom. The existing house is pre-existing, non-conforming <br /> because it does not meet the minimum front yard or minimum side yard setbacks. <br /> The new addition is on the North East corner of the existing dwelling <br /> measuring 14 feet by 6 feet and is designed to meet the minimum setbacks. The <br /> setback from the side is 15.5 feet and the setback from the front will be 40.5 feet. <br /> The current lot coverage is 14.1% and will increase to 15.9%. There is no <br /> substantial changes on the property and is not more detrimental to the <br /> neighborhood. <br /> 1 <br />
