• <br />Town <br />Nc,'s.hpee <br />16 Greot Areck lW d Arth <br />iWashpee, Alnssnchusetts 02649 <br />MASHPEE ZONING BOARD OF APPEALS <br />AUGUST 14, 2013 <br />MINUTES <br />The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, August 14, <br />2013, at 6:00 p.m. in the Waquoit Conference Room at the Mashpee Town Hall, 16 Great <br />Neck Road North. Board Members Jonathan D. Furbush, William A. Blaisdell, James <br />Reiffarth, Ronald S. Bonvie, Associate Members Domingo K. DeBarros and Richard J. <br />Jodka were present. Building Commissioner Richard E. Morgan, was also present. Board <br />Member John M. Dorsey was absent. <br />Chairman Jonathan D. Furbush opened the meeting at 6:00 p.m. and announced the <br />meeting was being televised live on local Mashpee television. <br />PLEDGE OF ALLEGIANCE <br />CONTINUED HEARINGS <br />Katharine F. and Brown Lineainfelter: Request a Written Finding under Article V <br />§174-17 of the Zoning By-laws and M.G.L. Chapter 40A §6 concerning continuance, <br />• extension or alteration of a pre-existing, non -conforming structure to construct a small <br />addition and detached boathouse with two bedrooms on property in an R-3 Zoning <br />District at 65 Seconsett Point Road (Map 124 Parcel 14-0-R) Mashpee, MA, at the <br />request of the Attorney, continued from July 24, 2013 public hearings. <br />Attorney Brian Wall, and John Slavinsky from Cape & Islands representing the <br />applicants stated the Lingamfelter's own the property and have an existing dwelling with <br />a detached garage on the property and are adding a boathouse with two bedrooms on the <br />second floor, with a new Title V Septic System. <br />On July 24, 2013, Attorney Brian Wall presented the project to the Board and established <br />the property has non -conforming structures and a non -conforming lot. He stated the <br />project is not more substantially more detrimental to the neighborhood than the existing <br />structures and uses. The hearing was continued because the Board wanted clarification of <br />the architectural and floor plans and also had concerns regarding the one lane road. <br />Brian stated he reviewed the assessors' map and the road provides adequate access to 36 <br />properties. He stated the proposed project would not cause any additional demands on the <br />roadway and his client is not creating a new lot or dwelling. The project is to add onto the <br />current single-family dwelling and build a boat house. He stated the property is adequate <br />for emergency access and is beyond the purview of the Board of Appeals to address and <br />is a matter for the Planning Board. He stated the Planning Board reviews applications and <br />has the authority for new sub -divisions whether it's carving out one or two lots or <br />whether it's a full blown sub -division. The Planning Board looks at "suitability" of the <br />road, i.e. adequate width, grades, and drainage to support traffic. <br />
