Town of Mashpee <br /> Planning Board <br /> Minutes of Meeting <br /> Eecutive Session <br /> February 5, 2003 <br /> The Town of Mashpee Planning Board entered into <br /> Executive Session at 9:20 p.m. on Wednesday, February 5, <br /> 2003 . The Chairman, Beverly Kane, presided. <br /> Planning Board Members present.: Beverly Kane, <br /> Chairman; Dennis Bal arini, Vice Chairman; Steve Dolan, <br /> Clerk; Don Myers; and Richard Terry. <br /> Also present: Thoma-s Eudala, Town Planner; Eric Smith, <br /> Assi t nt Town Planner; and Charles Rowley, Consulting <br /> Engineer. <br /> The- Chairman er�tert-ained a motion to enter into <br /> Executive Session for the purpose of discussion of possible <br /> Planning Board standing in a legal matter. <br /> MOTION: Dennis Bal ari.ni made a Motion to enter into <br /> Executive Session, not to return to regular session, for <br /> the purpose of discussion of possible Planning Board <br /> standing in a legal matter; which Motion 'was seconded by <br /> Richard Terry. <br /> Voting in favor: Beverly Kane, Dennis Bal arini, Steve <br /> Dolan, Don Myers and Richard Terry. <br /> The Town. Planner explained this to be two Zoning Board <br /> f Appeals (hereinafter referred to as ZBA) hearing cases. <br /> He made reference to Deerfield Toad, unbuildable lot, <br /> donated to the Audubon Society by Mr. Bornstein, which <br /> property was thereafter traded and ultimately sold to <br /> someone else who has applied to the ZBA for frontage <br /> variance. Said variance has been granted from the ZBA, <br /> which deiion was apealed by the abutters in the lower <br /> courts_ Leslie Morse being the attorney representing the <br /> abutters . <br />
