MASHPEE ZONING BOARD OF APPEALS <br /> Craig A. Fitzgerald and Maureen A. Fitzgerald <br /> 50 Spoondrift Way(Map 112 Parcel 35) <br /> Mashpee, MA 02649 <br /> FINDING-2013-31 <br /> Although said finding shall not constitute a special permit as defined by the general <br /> laws and this by-law, the Board of Appeals shall follow the procedures specified in the <br /> general laws for special permits in processing requests for such findings. For the purposes <br /> hereof, compliance with dimensional requirements shall be determined by the Inspector of <br /> Buildings.History:Amended 10-4-1993 ATM,Article 24,approved by Attorney General 10-18-1993. <br /> History:Amended 10-17-2005 ATM,Article 22,approved by Attorney General 3-7-2006. <br /> Specific Written Findings: <br /> The Board determined that the proposal shall not be substantially more detrimental <br /> than the existing non-conforming structure or use to the neighborhood, as defined under <br /> Section 174-17 of the Zoning By-laws, and contingent upon the following: <br /> • A revised plot plan depicting the 30 foot setback from the wetlands to the corner of <br /> the dwelling. <br /> • Confirmation of the elevations of the dwelling will not exceed 35 feet from the <br /> average grade. <br /> • Verification, stamp and signed house plans with signatures. <br /> • Board of Health approval based on the number of bedrooms. <br /> • Has adequate parking. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> Written Finding. Upon motion duly made and seconded at the Public Hearing on August <br /> 28, 2013, the Zoning Board of Appeals voted unanimously to grant a Written Finding to <br /> allow for the proposal. This Decision is contingent upon compliance with plot plans that <br /> refer to this project drafted by BSS Design Engineering& Surveying Plot Plan—Proposed <br /> House and Subsurface Sewage Disposal System Upgrade 50 Spoondrift Way, Mashpee, <br /> MA, scale 1"=20% dated September 2, 2013, drawn TJB, job number 13003, entitled <br /> Existing & Proposed Comparison, drawing number B21-76. Also includes house plans <br /> entitled, Fitzgerald Residence, 50 Spoondrift Way, Mashpee, MA 02649, and Proposed <br /> Front Elevation scale: '/a" = 1'-0, "Average Original Grade +14.5', FF Basement Level <br /> +13.5', dated, August 26, 2013, SCH 11 B, A5, A613,AT <br /> ,f <br /> is <br /> 3 <br />
