Chapter 40A §6 concerning continuance, extension or alteration of a pre- <br /> existing,non-conforming structure to allow for construction of a shed located in an <br /> R-5 Zoning District at 28 Valerie Circle, (Map 37 Parcel 80A), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The Mashpee <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, on August <br /> 9, 2013 and August 16, 2013 a copy of which is attached hereto and made a part <br /> hereof. <br /> On August 28, 2013, Public Hearings were held on this Petition at the <br /> Mashpee Town Hall at which time the following Board members were present, <br /> Jonathan D. Furbush,William A. Blaisdell,James Reiffarth,Ronald S.Bonvie, and <br /> Associate Member, Domingo K. DeBarros. Also present was Richard Morgan, <br /> Building Commissioner.Board Members John M. Dorsey, and Richard Jodka were <br /> absent. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provision of Massachusetts General Laws Chapter 40A §9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Cynthia Bartos, homeowner presented her petition to the Board requesting <br /> to install a new 10 foot by 14 foot shed replacing a 10 foot by 12 foot shed, on a <br /> pre-existing, non-conforming lot. The new shed will boarder an undeveloped <br /> parcel, will eliminate the close proximity to the side setback, and is well under the <br /> required lot coverage. The shed will accommodate all power tools, a lawn mower, <br /> snow blower, etc. <br /> Jonathan Furbush stated with the odd shape and topography of the lot; he <br /> approves the new location for the shed. <br /> There were no comments from abutters. <br /> 1 <br />
