His request to postpone the matter <br /> to June is based upon the Cape Cod Commission Decision, <br /> "...the first guy in wins..." premise. <br /> The Town Planner clarified said Decision requires <br /> signed contracts for a certain number of providers, as well <br /> as a Planning Board special Permit . <br /> The Chairman determined it would be unfair to the <br /> previous Applicant to postpone these -matters to June- due to <br /> the inability of Mr. Joyal or his representative to be <br /> present at the May 21st Meeting, <br /> Mr. Joyal requested fair and equitable treatment, <br /> stating it is imperative for him as the owner to b present <br /> in order to spear and answer Board questions relative to <br /> the proposed project. <br /> _The_ Boar' d- .attempted to--persuade- Applicant- to rear-range., - - <br /> his previous commitment on May 21St or t appoint a <br /> p pp <br /> representative to appear in his stead, which would allow <br /> hint to attend the Planning Board Meeting on the 215t. <br /> Recognizing the difficult situation and in an attempt <br /> to not place a hardship on either Applicant, it was the <br /> consensus of the Board to schedule both ratters on the <br /> it <br /> agenda for May 21 . The Board recognized these matters are <br /> two very distinct and separate projects. <br /> The Chairman determined that each individual project <br /> .is to be decided on their merits .
