MASHPEE ZONING BOARD OF APPEALS <br /> Paul M. Colella and Patricia H. Colella <br /> 15 Bayview Road and 20 Riverside Road <br /> (Map 119 Parcels 114 and 116), Mashpee, MA 02649 <br /> FINDING-2013-34 <br /> Issuing said finding the Board also finds that the property is not substantially more <br /> detrimental than the existing non-conforming structure and the new dwelling will be an <br /> improvement, will conform to current building code requirements, and is comparable to <br /> size and character to other structures in the neighborhood and has sufficient parking and <br /> setbacks as maybe required. <br /> General Finding: <br /> The subject property located at 15 Bayview Road/20 Riverside Road consists of <br /> approximately 36,150 square feet. <br /> Written Finding Criteria: <br /> §174-20. Rebuilding of Destroyed or Damaged Nonconforming Structure Any <br /> non-conforming building or structure destroyed or damaged by fire, flood lightning, wind <br /> or otherwise may be rebuilt, subject to approval of the Board of Appeals subject to the <br /> same conditions as set forth in §174-24 of this chapter. <br /> There were no comments from abutters. <br /> Specific Written Findings: <br /> The Board determined the proposal shall not be substantially more detrimental than <br /> the existing non-conforming structure or use to the neighborhood, and contingent upon the <br /> following: <br /> • Board of Health-memorandum dated September 11,2013-"The owners stopped by <br /> and dropped off floor plans for the garage with unfinished storage above, the main <br /> house at 20 Riverside and for the cottage which is being razed, as required. The <br /> septic inspection that was required was done,per the owners,but I do not have the <br /> final report. The owners stated that the system passed and risers were going to be <br /> added. I have approved the Title V design plan for the new three-bedroom dwelling. <br /> Once a septic installer has pulled the permit,the BOH will sign-off on the Building <br /> Permit." <br /> • Board of Health-memorandum dated September 10, 2013-"Not in Zone II. A <br /> housing inspection of the existing dwellings and garage is required by an agent of <br /> the Board of Health. Site and Design plans under review are for a repair of the <br /> existing leaching facility. Any increase in bedrooms will require additional <br /> percolation tests and the installation of an Innovative/Alternative denitrification <br /> unit." <br /> • Board of Health confirmation of the septic location of the Riverside Road lot. <br /> 2 <br />
