Colella <br /> requesting a Written Finding under Article V §174-17 of the Zoning By-laws of the Zoning <br /> By-laws and M.G.L. Chapter 40A §6 concerning continuance, extension or alteration of a <br /> pre-existing, non-conforming structure to raze and replace a dwelling on property located <br /> in an R-3 Zoning District at 15 Bayview Road and 20 Riverside Road (Map 119 Parcels <br /> 114 and 116) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on August 23, 2013 and August 30, 2013 a <br /> copy of which is attached hereto and made a part hereof. <br /> On September 11, 2013 Public Hearings were held on this Petition at the Mashpee <br /> Town Hall at which time the following Board members were present, Vice Chairman, <br /> William A. Blaisdell, Clerk,Ronald S.Bonvie,Board Member,James Reiffarth,Associate <br /> Members, Domingo K. DeBarros, and Richard Jodka, and Building Commissioner, <br /> Richard Morgan. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provision of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. Colella presented his petition to the Board stating he purchased the first parcel <br /> in 1968 which was 50 feet wide and approximately 242 feet deep and runs between <br /> Riverside Road and Bayview Road. In 1981, he purchased the adjacent lot consisting of <br /> 100 square feet. He is requesting to raze and replace the cottage facing Bayview with a <br /> new home approximately 3,000 square feet without a garage. The plan shows 36,070 <br /> square feet total for both lots. <br /> The original plan dated July 29, 2013 shows both lots stamped and drawn by <br /> Holmes and McGrath, Inc. The Board requested a revised plan showing the percentage of <br /> the lot with the proposed 3,000 square foot dwelling to be constructed on Bayview Road. <br /> The Board also requested an updated plan showing the lot coverage for all the structures <br /> shown with the total 36,070 square feet stamped by certified engineers and showing prior <br /> construction designs and after construction designs with the 20% lot coverage. <br /> 1 <br />
