MASHPEE ZONING BOARD OF APPEALS
Paul M. Colella and Patricia H. Colella
15 Bayview Road and 20 Riverside Road
(Map 119 Parcels 114 and 116), Mashpee, MA 02649
FINDING-2013-33
Specific Written Findings:
The Board determined the proposal shall not be substantially more detrimental than
the existing non-conforming structure or use to the neighborhood,as defined under Section
174-17 of the Zoning By-laws, and contingent upon the following:
• Board of Health-memorandum dated September 11,2013-"The owners stopped by
and dropped off floor plans for the garage with unfinished storage above, the main
house at 20 Riverside and for the cottage which is being razed, as required. The
septic inspection that was required was done, per the owners, but I do not have the
final report. The owners stated that the system passed and risers were going to be
added. I have approved the Title V design plan for the new three-bedroom dwelling.
Once a septic installer has pulled the permit, the BOH will sign-off on the Building
Permit."
• Board of Health-memorandum dated September 10, 2013-"Not in Zone II. A
housing inspection of the existing dwellings and garage is required by an agent of
the Board of Health. Site and Design plans under review are for a repair of the
existing leaching facility. Any increase in bedrooms will require additional
percolation tests and the installation of an Innovative/Alternative denitrification
unit."
• Board of Health confirmation of the septic location of the Riverside Road lot.
• Has sufficient parking and setbacks as required.
In view of the foregoing, the Board determined the Petitioner met the criteria for a
Written Finding. Upon motion duly made and seconded at the Public Hearings on
September 11, 2013, the Zoning Board of Appeals voted unanimously to grant a Written
Finding to allow for the proposal. This Decision is contingent upon Board of Health
approval and compliance with plot plans that refer to this project drafted and referencing
plans drawn by Holmes and McGrath, Inc. dated July 29, 2013. Revisions to plans of
proposed sewage disposal system prepared for Paul and Patricia Colella, 15 Bayview Road,
scale: 1"=20',job number 213117, drawing number 61-3-8A, sheet 1 of 2, and referencing
house plans drawn by Custom Home Design, Residential/Commercial Design, Drafting,
Permitting & Consulting, PO Box 383, East Falmouth, MA, for Colella Residence,
Bayview Road, Seconsett Island, Mashpee, MA, scale %" = l'-0", dated 8/14/2013,
drawing by SPB, revisions dated: 7/31/13, Drawing Numbers Al through A5 and S1
conclusive.
4
t
3
