Joia, Jr. and Darlene E. Joia <br /> requesting a Written Finding under Article V §174-17 of the Zoning By-laws and M.G.L. <br /> Chapter 40A §6 concerning continuance, extension or alteration of pre-existing, non- <br /> confortning structure to relocate a shed on property located in an R-5 Zoning District at 49 <br /> Somerset Road, (Map 16 Parcel 11), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee,on September 6,2013 and September 13,2013 <br /> a copy of which is attached hereto and made a part hereof. <br /> On September 25, 2013 Public Hearings were held on this Petition at the Mashpee <br /> Town Hall at which time the following Board Members were present, Chairman, Jonathan <br /> D. Furbush, Vice Chairman, William A. Blaisdell, Clerk, Ronald S. Bonvie and Associate <br /> Member, Domingo K. DeBarros. Also present was Building Commissioner, Richard <br /> Morgan. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provision of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. Arthur Joia, Petitioner, presented a plot plan that depicted a non-conforming <br /> lot on a cul-de-sac called Somerset Road. The left side property is a "paper road" called <br /> Tobeys Back Road that is a dirt wooded road. There are seven homes in this area, and the <br /> back of the lot is narrow and triangular shaped and abuts conservation land along the left <br /> side. He stated he was granted a variance at a meeting back in 1995 to move his garage, <br /> and is requesting the same relief of 3 foot 3 inches for his shed. He purchased the shed fully <br /> assembled to store his yard tools and lawn mower. The shed is 10 feet by 18 feet (180 <br /> square feet) and is currently stored on top a trailer. <br /> 1 <br />
