<br />Southworth Cape Development LLC: Request a Variance under Article VII §174-31
<br />(Land Space Requirements) of the Zoning By-laws to reduce the required land area from
<br />40,000 square feet to 23,983 square feet, and reduce required frontage from 150 feet to 130
<br />feet on property located in an R-3 Zoning District at 61 Pleasant Park Drive (Map 70 Parcel
<br />162), Mashpee, MA.
<br />Attomey, Jack McElhinney represented the applicant at Southworth Cape Development
<br />LLC. He stated the lot is vacant and located off Quinaquisset Avenue. It's a (30) thirty lot
<br />subdivision made up of Pleasant Park Drive and Angelo's Way. The lot in question is
<br />number 17 and it boarders the cul-de-sac. The lot has 23,983 square feet of lot area and
<br />114 feet of frontage. The lot is oddly shaped due to its location on the cul-de-sac and
<br />being bounded to the north by the ancient way known a Quippish Road. The lot is part of
<br />an eight lot subdivision on the westerly side of Pleasant Park.
<br />A sewer connection to the Willowbend treatment plant and ornamental fencing has been
<br />provided to service the entire subdivision. As shown on the attached plan, all of the other
<br />lots within the Pleasant Park/Angelo's Way neighborhood are similar size and frontage and
<br />are therefore non -conforming with respect to the current 40,000 square foot minimum lot
<br />area and 200 foot frontage requirement in the R-3 zoning district. Preliminary building
<br />envelopes have been developed for the lot, and no setback, lot coverage or eight variances
<br />will be required. A prospective buyer has recently made an offer to acquire the premises
<br />and wants to confirm it is buildable.
<br />Mr. DeBarros read into the record a memorandum dated September 20, 2013 from
<br />Catherine Laurent, Director of the DPW. "With regard to the subject application regarding
<br />61 Pleasant Park Drive, please be advised that any construction on the lot including
<br />installation of utilities, shall require a permit from the DPW".
<br />Mr. Bonvie made a motion to issue a Variance to Southworth Cape Development LLC:
<br />under Article VII §174-31 (Land Space Requirements) of the Zoning By-laws to reduce
<br />the required land area from 40,000 square feet to 23,983 square feet, a 16,017 square foot
<br />Variance and reduce required frontage from 150 feet to 114 feet which would be a Variance
<br />of 36 feet on property located in an R-3 Zoning District at 61 Pleasant Park Drive (Map 70
<br />Parcel 162), Mashpee, MA. This motion is subject to a request from CatherineLaurent,
<br />Director regarding a DPW permit and restricted to the envelope on the proposed plot plan.
