In order to obtain the necessary relief, the Gooseberry Island Trust filed <br /> I <br /> a petition with the Mashpee Zoning Board of Appeals, on or about <br /> I <br /> August 29, 2013, requesting variances from these three sections of the <br /> Zoning Bylaw. <br /> 11. On October 9, 2013, the Board of Appeals held a public hearing on the <br /> Trust's petition. <br /> I <br /> 12. At the close of the hearing, the Board voted 4 to 1 to deny the petition. <br /> 13. On October 22, 2013, the Board of Appeals fled three separate written <br /> decisions with the Town Clerk denying the Trust's petition, Each o '�) g P i the <br /> decisions addressed one of the three variances that the Trust requested. <br /> i <br /> �I True and accurate copies of the decisions are attached hereto as Exhibits <br /> i <br /> I� <br /> A, B and C. <br /> j14. In essence, the Board denied the Trust's petition because of concerns <br /> �i <br /> with public safety, provision of emergency services to the island, and <br /> with whether the Trust demonstrated a hardship. <br /> 15.
