Town or, Mashpee <br /> 11, <br /> 130ARD OF AIPPEA.LS <br /> I <br /> February 27,............... 9.74, <br /> ................................ <br /> Cod United <br /> Decision of the Board of Appeals on the appeal and petition of....Cape <br /> Church.................Homes Inc. .................. <br /> .............__.......... ...._...............,.....,__..........................._..... <br /> petitioner Cape Cod United Church Homes, Inc. <br /> Hearing September 12, 1973 <br /> Appeals Board: Lawrence, Keliinui, O'Connell <br /> Facts <br /> Cape Cod United Church Homes, Inc. hereafter called the petitioner applied on <br /> August 2, 1973 for a variance to construct 72 one-bedroom, 40 two-bedroom, and <br /> 30 three-bedroom multi-family units contained in 21 buildings on 52 acres of <br /> land located on Old Barnstable Road (See attachment A) . <br /> "The Mashpee Zoning By-haw dated January 31, 1973 provides under Section 9.3 for <br /> multi-family development in the Town of Mashpee: The petitioners request for <br /> ; a variance did not meet the requirements set forth in Section 9.3. <br /> The Appeals Board and the Planning Board suggested to the petitioner that they <br /> redesign the land plan to meet the requirements of Sec. 9.3. <br /> The new plans submitted to the Appeals and Planning Boards show 114 multi-family <br /> units containing 72 one-bedroom, 40 two-bedroom, and 2 three-bedroom units. Also <br /> '= a plan for a thirty six lot single-family subdivision was submitted in accordance <br /> with Section 9.3. <br /> Decision <br /> The Board of Appeals herein issues to the petitioner a Special Permit for the <br /> construction of the multi-family development with the following conditions . <br /> A. All requirements of Section 9 .374 shall be presented <br /> to the Appeals Board at the same time as the petition- <br /> er submits materials to the Planning Board as required � 5 <br /> by Section 9.38. <br /> B. The multi-family project shall be phased over a two- <br /> year period with no more than fifty-seven (57) units <br /> constructed within each year.
