f,20tt r� <br /> Town qf Mashpee <br /> 10 Great N'eck&adl lbah <br /> aVS�:fni iu Mashpee;Massachusetts OP-649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> V-2013-48 <br /> Lazar Koyfinan and Yelena Yulikova Book 18867 Page 66 <br /> 79 Pond Circle (Map 64 Parcel 80) DOC# 59176 <br /> Mashpee, MA 02649 <br /> A Petition was filed on August 26, 2013 requesting a Variance under Article V <br /> §174-31 (Land Space Requirements) of the Zoning By-Laws to vary the rear and side <br /> setback requirements to allow for construction of a deck on property located in an R-5 <br /> Zoning District at 79 Pond Circle (Map 64 Parcel 80), Mashpee, MA <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on September 20, 2013 and September 27, <br /> 2013 a copy of which is attached hereto and made a part hereof. <br /> On October 9, 2013, Public Hearings were held on the Petition at the Mashpee <br /> Town Hall at which time the following members of the Board were present and acting <br /> throughout: Chairman, Jonathan D. Furbush, Vice Chairman, William A. Blaisdell, Board <br /> Members, James Reiffarth and Richard Jodka, and Associate Member, Domingo K. <br /> DeBarros. <br /> Yelena(Yulikova)Koyfman represented her petition and plot plan to the Board and <br /> stated her current deck is very narrow and dangerous with dimensions of 32' x 8'. She <br /> would like to rebuild the deck with slightly larger dimensions at 32' x 16'. She stated she <br /> met with Conservation. <br /> Mr. Furbush stated the dwelling is located in a "cluster" and does not require any <br /> setbacks however, a 50 foot setback from wetlands is required. The Conservation <br /> Commission commented: "RDA Application approved by Conservation Commission on <br /> September 12,2013-no impacts". The plot plan depicted the new deck setback at 48.2 feet <br /> and the Board determined the required allowance is 1.8 feet. <br /> There were no comments from abutters. <br /> General Criteria: <br /> The subject property located at 79 Pond Circle is approximkwf , U JOWMOLEIRK <br /> OCT 1 5 2013 <br /> RECEIVED BY <br /> 1 <br />
