This action is an appeal pursuant to Mass. G. L., Chapter 40A, Section 17 from three (3) <br /> Decisions of the Mashpee Zoning Board of Appeals issued in regard to real estate <br /> situated at 17 Overlook Knoll Road, Mashpee, MA simultaneously on November 26, <br /> 2013. In a Decision identified as "Finding -2013-49," the Board of Appeals voted to <br /> allow demolition of the existing residence and construction of a new residence in place <br /> of the existing, non-conforming residence (hereafter referred to as "Non-Conforming <br /> Use Decision"). In a Decision identified as "Finding-2013-50," the Board of Appeals <br /> voted to allow demolition of the existing residence and construction of a new residence <br /> on the basis of Town of Mashpee By-Law §174-20, which allows the rebuilding of a <br /> destroyed or damaged non-conforming structure (hereafter referred to as "Damaged <br /> Non-Conforming Use Decision). Ina Decision identified as "V-2013-51," the Board of <br /> Appeals voted to grant a Variance allowing demolition of the existing residence and <br /> construction of a new residence without the required setback on Seaview Avenue <br /> (hereafter referred to as "Variance Decision"). Copies of each of the three Decisions <br /> are attached as Exhibit A (Non-Conforming Use Decision), Exhibit B (Damaged Non- <br /> Conforming Use Decision), and Exhibit C (Variance Decision). <br /> 1 <br />
