Yeomans Certificate of Title#: 183235 <br /> 23 Birch Way Land Court Lot#: 33 <br /> Mashpee, MA 02649 Plan#: 28727 C Sheet 3 <br /> (Map 27 Parcel 88) <br /> A Petition was filed on October 28,2013 by Edward H. and Karen E.Yeomans <br /> requesting a Variance from Article V §174-31 of the Zoning By-laws to vary the front, <br /> rear and side setbacks to allow for construction of a 263 square foot deck and outdoor <br /> kitchen with raised seating area and trellis on property located in an R-5 Zoning District <br /> at 23 Birch Way, (Map 27 Parcel 88), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on October 25, 2013 and <br /> November 1, 2013 a copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Tom Bunker,of BSS Design represented the Petitioners for their proposal of an <br /> outdoor kitchen patio, with a fireplace and pergola. The plans depicted the pergola <br /> columns on the South side of the house as close as 3 feet from the property line and <br /> should be within 25 feet, which is considered a structure so would require a 22 foot <br /> variance. <br /> The Board suggested the Petitioner continue the petition and return with <br /> updated plans. The Board made a motion to accept an extension until the hearings dated <br /> December 11, 2013. <br /> On Wednesday,December 11, 2013,Public Hearings were held on the Petition <br /> at the Mashpee Town Hall at which time the following members of the Board were <br /> present and acting throughout Jonathan D. Furbush, Chairman, William A. Blaisdell, <br /> Vice Chairman, Associate Members, Domingo K. DeBarros and Scott Goldstein. Also <br /> present was Building Commissioner, Richard E. Morgan. <br /> 1 <br />
