<br />Mr. Bonvie made a motion to issue a Written Finding to Michael and Lori Laskin Bloom
<br />under Article V §174-17 of the Zoning By-laws and M.G.L. Chapter 40A §6 concerning
<br />continuance, extension or alteration of a pre-existing, non -conforming structure to raze and
<br />replace a dwelling on property located in an R3 Zoning District at 17 Overlook Knoll Road,
<br />(Map 118 Parcel 36), Mashpee, MA. The Proposed Sewage Disposal System prepared for
<br />Lori and Michael Bloom, House No. 17 Overlook Koll, Mashpee, MA. Scale as noted:
<br />dated October 28, 2013, prepared by Cape & Island Engineering, Plan No. 102813,
<br />File No. 125 MA, and revised October 29, 2013 Building Moved Forward To Existing
<br />Deck Setback. Also, referencing Proposed Site Plan wBasement Plan, dated 10.28.13,
<br />Bloom Residence, 17 Overlook Knoll, Scale: 1/16" = F-0", and numbered 0.0, A.0 through
<br />A.7 and is subject to Board of Health approval.

<br />Mr. Bonvie made a motion to issue a Written Finding under Article V §174-20 of the
<br />Zoning By-laws and M.G.L. Chapter 40A §6 By-laws concerning rebuilding of destroyed
<br />or damaged non -conforming structures to allow for rebuilding of a single-family dwelling
<br />on property located in an R3 Zoning District at 17 Overlook Knoll Road (Map 118 Parcel
<br />36), Masbpee, MA. The Proposed Sewage Disposal System prepared for Lori and Michael
<br />• Bloom, House No, 17 Overlook Koll, Mashpee, MA. Scale as noted: dated October 28,
<br />2013, prepared by Cape & Island Engineering, Plan No. 102813, File No. 125 MA, and
<br />revised October 29, 2013 Building Moved Forward To Existing Deck Setback. Also,
<br />referencing Proposed Site Plan wBasementPlan, dated 10.28.13, Bloom Residence, 17
<br />Overlook Knoll, Scale: 1/16" = F-0", and numbered 0.0, A.0 through A.7 and is subject
<br />to Board of Health approval.
<br />The Board finds the application is not substantially more detrimental than the existing non-
<br />conforming structure. The new dwelling will be an improvement and will conform to
<br />current building code requirements that are similar to size and character to other structures
<br />in the neighborhood and will have sufficient parking and setbacks as required.

<br />Mr. Bonvie made a motion to issue a Variance under Article VII §174-31 (Land Space
<br />Requirements) of the Zoning By-laws to vary the rear setback requirement on Seaview
<br />from 25 feet to 20 feet which is a 5 foot variance to raze and replace a new single-family
<br />dwelling on property located in an R-3 Zoning District at 17 Overlook Knoll Road (Map
<br />118 Parcel 36), Mashpee, MA. Referencing the Proposed. Sewage Disposal System
<br />prepared for Lori and Michael Bloom, House No. 17 Overlook Koll, Mashpee, MA. Scale
