Smith <br /> requesting a Special Permit under §174-25 (I) (9) of the Zoning By-laws to allow for <br /> construction of a landing, stairs,pier,ramp and float extending across a total of more than <br /> seventy feet of coastal beach, coastal bank, salt marsh, or bordering vegetated wetlands <br /> and/or coastal wetlands, freshwater wetlands, swamps or marshes on property located in <br /> an R-3 Zoning District at 266 Monomoscoy Road (Map 120 Parcel 57B), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on November 22, 2013 and November 29, <br /> 2013 a copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provision of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> On December 11, 2013 Public Hearings were held on this Petition at the Mashpee <br /> Town Hall at which time the following Board Members were present; Board Members <br /> Jonathan D. Furbush,William A.Blaisdell,Associate Members Domingo K.DeBarros and <br /> Scott Goldstein were present.Building Commissioner Richard E.Morgan was also present. <br /> The Board requested a continuance until January 8, 2014 due to a violation issued <br /> by Board of Health regarding an operations and maintenance contract for the <br /> innovative/alternative septic system. <br /> On January 8,2013 Public Hearings were held on this Petition at the Mashpee Town <br /> Hall at which time the following Board Members were present; Chairman, Jonathan D. <br /> Furbush, Vice Chairman, William Blasdell, Board Members James Reiffarth and Richard <br /> Jodka, and Associate Members, Domingo K. DeBarros and Scott Goldstein. Also present <br /> was Building Commissioner, Richard Morgan. <br /> Mr. Thomas Smith, homeowner representing himself presented a plot plan <br /> depicting a 182 feet wooden walkway to Great River to be used for kayaks and dinghies <br /> only. <br /> 1 <br />
