Rafla Certificate of Title: 199838 <br /> 45 Little Neck Lane Land Court Lot#717 <br /> (Map 115 Parcel 15 Plan#: 11408-48 <br /> Mashpee, MA 02649 <br /> A Petition was filed on November 1, 20.13 by Akram E. and Marta O. Rafla <br /> requesting a Written Finding under §174-17 of the 'Zoning By-laws and M.G.L. Chapter <br /> 40A §6 concerning continuance, extension or alteration of a pre-existing, non-conforming <br /> structure to allow for a new second floor addition on property located in an R3 Zoning <br /> District at 45 Little Neck Lane, (Map 115 Parcel 15), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on November 22, 2013 and November 29, <br /> 2013. <br /> On Wednesday, December 11, 2013, Public Hearings were held on the Petition at <br /> the Mashpee Town Hall at which time the following members of the Board were present <br /> and acting throughout Jonathan D. Furbush, Chairman, William A. Blaisdell, Vice <br /> Chairman, Associate Members, Domingo K. DeBarros and Scott Goldstein. Also present <br /> was Building Commissioner,Richard E. Morgan. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Tom Bunker,of BSS Design submitted a letter dated December 3,2013 to withdraw <br /> the petition for a Written Finding on behalf of Akram Rafla because the project falls under <br /> the New Seabury Special Permit. The Architectural Review Committee(ARC) controls all <br /> such decision for any project where the address falls under the New Seabury Special <br /> Permit. <br /> In view of the foregoing, the Zoning Board of Appeals determined the petition did <br /> not require a Written Finding and voted unanimously to withdraw without prejudice,upon <br /> motion duly made and seconded at the Public Hearings on Wednesday, December 11, <br /> 2013. <br /> 1 <br />
