Morrissey for a Special <br /> Permit under Section 174-45.4 of the Zoning By-laws for permission to construct an <br /> accessory apartment in an existing dwelling on property located in an R-3 zoning district <br /> at 35 Bayshore Drive(Map 108 Parcel 44) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on December 23, and <br /> December 30, 2011 a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on January <br /> 11, 2012. The following members of the Board were present and acting throughout: <br /> Board Members Robert G. Nelson, Jonathan D. Furbush, William Reiffarth, John M. <br /> Dorsey, and Ronald S. Bonvie. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mrs. Jan Morrissey represented her Petition and stated that she and her husband <br /> occupy the primary residence at 35 Bayshore Drive on a year-round basis. She submitted <br /> a copy of the 1995 ZBA Decision granting Variance relief of 4.6 feet from the front <br /> setback requirements and 3 feet from the side setback requirements to the previous <br /> owners of the subject property, Myles D. and Mary T. Huntingon. Mrs. Morrissey said <br /> that she purchased the parcel in 1997 and built a smaller home within the footprint that <br /> the previous owners had proposed. <br /> Mrs. Morrissey said that plans now call for construction of a one-bedroom <br /> accessory apartment in the basement of the dwelling. The accessory apartment shall be <br /> self-contained. No changes to the exterior of the structure are proposed. Existing lot <br /> coverage is 15.8%. <br /> 1 <br />
