MASHPEE ZONING BOARD OF APPEALS <br /> John F. and Norma D. Donnellan <br /> 59 Pond Circle <br /> Mashpee, MA 02649 <br /> Finding-2012-6 <br /> Richard D. Hall and Julie A. Hall, direct abutters at 63 Pond Circle, sent a letter to <br /> the ZBA office in favor of the proposal. <br /> General Findings: <br /> The subject property is located at 59 Pond Circle and consists of 15,900 square <br /> feet of land. <br /> U74-17 Continuance, Extensions,Alterations: <br /> Changes, extensions or alterations of non-conforming single- or two-family <br /> dwelling structures which do not meet the applicable dimensional requirements as set <br /> forth in this Section, and changes, extensions or alterations of all other non-conforming <br /> structures, or non-conforming uses, may not be made unless there is a written Finding by <br /> the Zoning Board of Appeals. <br /> Written Finding: <br /> The Board determined that the proposal shall not be substantially more <br /> detrimental than the existing non-conforming structure or use to the neighborhood for the <br /> following reasons: <br /> • the proposal is similar in character and style to other recently renovated homes <br /> in the neighborhood. <br /> • at 15% lot coverage, the proposal will remain well below the 20%maximum. <br /> • there is adequate parking and sufficient setbacks as may be required to <br /> accommodate this proposal. <br /> In view of the foregoing, the Board determined that the Petitioner met the criteria <br /> for grant of a Written Finding. Upon motion duly made and seconded at the Public <br /> Hearings on March 14, 2012, the Zoning Board of Appeals voted unanimously to grant <br /> the Written Finding.
