Rano <br /> requesting a Variance from Section 174-31 of the Zoning By-laws to vary the side <br /> setback requirements to allow for removal of an existing deck and construction of a new <br /> addition onto an existing dwelling on property located in an R-3 zoning district at 5 <br /> Forest Road (Map 117 Parcel 52)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on March 9, and March 16, <br /> 2012, a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on March <br /> 28, 2012. The following members of the Board were present and acting throughout: <br /> Board Members Robert G. Nelson, Jonathan D. Furbush, William A. Blaisdell, James <br /> Reiffarth and Ronald S. Bonvie. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Construction company owner Greg Clancy represented the Petition and stated that <br /> plans call for removal of a deck, which will be replaced with addition of a living room <br /> and a fireplace. The location of the septic system restricts placement of the proposed <br /> addition. <br /> Mr. Bonvie discovered an error and stated that the plan should show the distance <br /> from the proposed cantilever to the side setback, not the distance from the house to the <br /> side setback. Building Commissioner Richard E. Morgan stipulated that the plans <br /> showing the cantilever must be stamped by a structural engineer. <br /> No comments were received from abutters. <br /> General Findings: <br /> The subject property is located at 5 Forest Road and consists of 7,500 square feet of land. <br />
