MASHPEE ZONING BOARD OF APPEALS <br /> Alfred J. Clemens <br /> 58 Spoondrift Way <br /> Mashpee, MA 02649 <br /> SP-2012-14 <br /> Several comments were received from abutters expressing concern about the <br /> proposal blocking their views. The Board explained that the ZBA does not have <br /> jurisdiction over views. <br /> General Findings: <br /> The subject property is located at 58 Spoondrift Way and consists of approximately <br /> 28,375 square feet of land. <br /> Specific Findings: <br /> §174-20. Rebuilding of Destroyed or Damaged Nonconfonning Structure. <br /> Any non-conforming building or structure destroyed or damaged by fire, flood lightning, <br /> wind or otherwise may be rebuilt, subject to approval of the Board of Appeals subject to <br /> the same conditions as set forth in §174-24 of this chapter. <br /> In view of the foregoing, the Board determined that the Petitioner met the criteria <br /> for grant of a Special Permit. Upon motion duly made and seconded at the Public <br /> Hearings on March 28, 2012, the Zoning Board of Appeals voted unanimously to grant <br /> the Special Permit. This Decision is conditioned upon compliance with the following: <br /> • Conservation Commission approval. <br /> • Board of Health restrictions. <br /> • Christopher Costa & Associates, Inc. plan "Certified Plot Plan Showing <br /> Conservation Restrictions 58 Spoondrift Way in Mashpee, Massachusetts, Date <br /> 02/15/2012". <br /> 2 <br />
