AMN <br /> ry, 1Town ofMashpee <br /> 6 _' ecit d eck IZQacd Ji'or-Ih <br /> Mashpe ,Alassaelmsetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for Approval of a Petition for a Variance <br /> Petitioner: Mashpee Wampanoag Tribe <br /> 483 Great Neck Road South <br /> Mashpee, MA 02649 <br /> Registry of Deeds Title Reference: Boole: 23010 Page: 41 <br /> V-2012-10 <br /> A Petition was filed on March 2, 2012, by the Mashpee Wampanoag Tribe <br /> requesting a Variance from Section 174-31 of the Mashpee Zoning Bylaws to vary the <br /> height requirements and the number of stories to allow for construction of a three-story <br /> Government Center building on property located in an R-3 zoning district at 483 Great <br /> Neck Road South, Mashpee, Massachusetts. <br /> Notice of the hearing in this matter was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by publication in The <br /> Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on <br /> March 9, and March 16, 2012, a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall on March <br /> 28, 2012. The following members of the Zoning Board of Appeals were present and <br /> acting throughout: Board Members Robert G. Nelson, Jonathan D. Furbush, William A. <br /> Blaisdell, James Reiffarth and Ronald S. Bonvie. <br /> The Mashpee Zoning Board of Appeals ("Board") issues this Decision pursuant to <br /> and in accordance with the provisions of Massachusetts General Laws Chapter 40A and <br /> the Town of Mashpee Zoning By-laws. <br /> FINDINGS: <br /> 1. The Petitioner is the owner of real property located at 483 Great Neck Road <br /> South, Mashpee, MA (hereinafter"Subject Property"). <br /> 2. The Subject Property has 671.06 feet of frontage and is 2,556,972 square feet in <br /> area. <br /> 3. The Subject Property is located in an R-3 Zoning District. <br /> 4. Government buildings are allowed by right in an R-3 Zoning District. <br /> 5. There is an existing building located on the property which is 2 stories tall and <br /> �' 2,993 square feet in size. <br />
