Rossignol <br /> requesting a Special Permit under Section 174-45.4 of the Zoning By-laws to allow for <br /> construction of an accessory apartment in an existing dwelling on property located in an <br /> R-5 zoning district at 8 Hendricks Lane (Map 37 Parcel 48A) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on April 20, and April 27, <br /> 2012, a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on May 9, <br /> 2012 and June 27, 2012. The following members of the Board were present and acting <br /> throughout: Board Members Jonathan D. Furbush, William A. Blaisdell, James Reiffarth <br /> and Judith M. Horton. Board Member Ronald S. Bonvie was not present at the May 9, <br /> 2012 Public Hearings and submitted written certification that he met the requirements <br /> pursuant to Article 21 as passed at the October 16, 2006 Town Meeting. Mr. Bonvie was <br /> present at the June 27, 2012 Public Hearings. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> At the Public Hearings on May 9, 2012, Ms. Andrea Rossignol represented her <br /> Petition. She stated that she and her husband bought the home in February 2012 and <br /> would like to obtain a Special Permit for the existing accessory apartment. At 548 square <br /> feet,the accessory apartment is 33% of the 2,212 total square footage of the dwelling. <br /> On May 2, 2012, Assistant Board of Health Agent Veronica Warden performed a <br /> housing inspection and confirmed that the primary residence and the accessory apartment <br /> contain a total of four bedrooms. In a memo dated May 9, 2012, Ms. Warden said that <br /> the location of the property in a Zone II district restricts the dwelling to a total of four <br /> bedrooms. <br /> While conducting a site visit, Chairman Furbush observed an 18-wheeler parked <br /> on the subject property, which he informed Ms. Rossignol is illegal to park in a <br /> residential zone. Building Commissioner Richard Morgan requested that the Board delay <br /> rendering a Decision until the truck has been removed and is properly stored elsewhere. <br />
