Rossignol Registry of Deeds Title Reference:
8 Hendricks Lane Book: 26015 Page: 3312
Mashpee,MA 02649
Map 37 Parcel 48A
A Petition was filed on April 4, 2012 by Keith D. and Andrea L. Rossignol
requesting a Special Permit under Section 174-45.4 of the Zoning By-laws to allow for
construction of an accessory apartment in an existing dwelling on property located in an
R-5 zoning district at 8 Hendricks Lane (Map 37 Parcel 48A) Mashpee, MA.
Notice was duly given to abutters in accordance with Massachusetts General
Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a
newspaper of general circulation in the Town of Mashpee, on April 20, and April 27,
2012, a copy of which is attached hereto and made a part hereof.
Public Hearings were held on the Petition at the Mashpee Town Hall on May 9,
2012 and June 27, 2012. The following members of the Board were present and acting
throughout: Board Members Jonathan D. Furbush, William A. Blaisdell, James Reiffarth
and Judith M. Horton. Board Member Ronald S. Bonvie was not present at the May 9,
2012 Public Hearings and submitted written certification that he met the requirements
pursuant to Article 21 as passed at the October 16, 2006 Town Meeting. Mr. Bonvie was
present at the June 27, 2012 Public Hearings.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee
Zoning By-laws.
At the Public Hearings on May 9, 2012, Ms. Andrea Rossignol represented her
Petition. She stated that she and her husband bought the home in February 2012 and
would like to obtain a Special Permit for the existing accessory apartment. At 548 square
feet, the accessory apartment is 33% of the 2,212 total square footage of the dwelling.
On May 2, 2012, Assistant Board of Health Agent Veronica Warden performed a
housing inspection and confirmed that the primary residence and the accessory apartment
contain a total of four bedrooms. In a memo dated May 9, 2012, Ms. Warden said that
the location of the property in a Zone II district restricts the dwelling to a total of four
bedrooms.
While conducting a site visit, Chairman Furbush observed an 18-wheeler parked
on the subject property, which he informed Ms. Rossignol is illegal to park in a
residential zone. Building Commissioner Richard Morgan requested that the Board delay
rendering a Decision until the truck has been removed and is properly stored elsewhere.
