Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on April 20, and April 27, <br /> 2012, a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on May 9, <br /> 2012. The following members of the Board were present and acting throughout: Board <br /> Members Jonathan D. Furbush, William A. Blaisdell and James Reiffarth and Associate <br /> Member Judith M. Horton. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Ms. Santucci represented her Petition and submitted photos of her property. Plans <br /> call for addition of a 1Oxl6-foot mudroom/breezeway and 24x24-foot garage onto her <br /> home. At 32 feet from the front setback, the pre-existing, non-conforming dwelling does <br /> not conform to the 40-foot setback requirements. The proposal meets the lot coverage <br /> requirements as well as the frontage, rear, and side setback requirements. Lot coverage <br /> will increase from 7.5%to 11.9%, well below the 20% allowed. <br /> The soil absorption system restricts the dwelling to three bedrooms. The Board of <br /> Health said that the Petitioner can choose one of the following options for the space <br /> above the garage: installation of a 6-foot entranceway leading into the space; or the space <br /> must remain unheated. Ms. Santucci stated that the space above the garage is for storage <br /> purposes. The mudroom will be heated. <br /> No comments were received from abutters. <br /> ,4 <br />
