O'Brien, <br /> Trustees, requesting a Written Finding under Section 174-17 of the Zoning By-laws and <br /> under M.G.L. Chapter 40A Section 6 regarding changes, extensions or alterations of a <br /> pre-existing, non-conforming structure or use to allow for construction of a 24x26-foot <br /> garage on property located in an R-3 zoning district within the Popponesset Overlay <br /> District at 11 Bearse Road(Map 117 Parcel 316) Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on June 8, and June 15, 2012, <br /> a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on June 27, <br /> 2012. The following members of the Board were present and acting throughout: Board <br /> Members Jonathan D. Furbush, William A. Blaisdell, James Reiffarth, Ronald S. Bonvie <br /> and Judith M. Horton. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. and Mrs. O'Brien represented their Petition. The pre-existing, non- <br /> conforming dwelling on the property does not meet the front setback requirements. Plans <br /> call for construction of a detached 24x26-foot garage. Mr. O'Brien and Mrs. O'Brien <br /> said that the garage will provide much needed storage and protection for their vehicles <br /> from inclement weather. Lot coverage with the proposal will increase from 15.60% to <br /> 20.41%. The proposal will not encroach into the front, side or rear setback requirements. <br /> The Board of Health memo dated June 24, 2012 limits the area above garage for <br /> storage only;no additional habitable space in the garage shall be permitted. <br /> No comments were received from abutters. <br /> General Findings: <br /> The subject property is located at 11 Bearse Road and consists of 13,000 square feet of <br /> land. <br />
