"its,4rs- _' 1 v s1 } MASHPEE ZONING BOARD OF APPEALS DECISION FOR A SPECIAL PERMIT SP-2012-29 Petitioner: Panera, LLC Owner of Record: Mashpee Commons II LLC 8 Steeple Street Registry of Deeds Title Reference: Mashpee, MA 02649 Book: 7408 Page: 46 Map 74 Parcel 20 Certificate of Title: 121818 A Petition was filed on May 29, 2012 by Panera, LLC requesting a Special Permit under Section 174-51.13 of the Zoning By-laws to allow for installation of signs exceeding twenty square feet onto a commercial building on property located in a C-1 zoning district at 8 Steeple Street (Map 74 Parcel 20) Mashpee, MA. Owner of record: Mashpee Commons II LLC. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on June 8, and June 15, 2012, a copy of which is attached hereto and made a part hereof. Public Hearings were held on the Petition at the Mashpee Town Hall on June 27, 2012. The following members of the Board were present and acting throughout: Board Members Jonathan D. Furbush, William A. Blaisdell, James Reiffarth, Ronald S. Bonvie and Judith M. Horton. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. Mr. Rich Pretorius of Pretorius Electric and Sign Co. and Mr. Mann Braga of Cornerstone Design/Build Services, Inc. represented the Petition. Mr. Pretorius said that each of the Panera Bread signs will be 57.92 square feet in size. Mr. Braga explained that the signs are actually letters attached to the siding of the building. Given that the Petitioner has frontage on two streets, one sign will face Route 28 and the other will face Steeple Street. Each of the corner blade signs will be 6.25 square feet in size. Total square footage of all of the signs is approximately 120 square feet. The total square footage of both walls is 2,600 square feet. This falls below the By-law maximum which allows signs up to 10%of the aggregate square footage of a front wall area. The Design Review Committee approved the proposal on March 20, 2012. No comments were received from abutters.
