Dayos Certificate of Title: 145231 <br /> 30 Bakers Road Plan#: 18568-A <br /> Mashpee,MA Map 20 Parcel 5 <br /> A Petition was filed on June 29, 2012 by Peter Dobyns and Tanya C. Dayos <br /> requesting a Written Finding under Section 174-17 of the Zoning By-laws and under <br /> M.G.L. Chapter 40A Section 6 regarding changes, extensions or alterations of a pre- <br /> existing, non-conforming structure to allow for changes which will include renovation of <br /> a first floor, removal of a roof structure and construction of a second story onto a <br /> dwelling on property located in an R-5 zoning district at 30 Bakers Road (Map 20 Parcel <br /> 5) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on July 6, and July 13, 2012, <br /> a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on July 25, <br /> 2012. The following members of the Board were present and acting throughout: Board <br /> Members Jonathan D. Furbush, William A. Blaisdell, James Reiffarth, Ronald S. Bonvie <br /> and Judith M. Horton. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> President of Falmouth Engineering, Michael Borselli represented the Petition. <br /> Due to a previous violation in which the Petitioner failed to obtain a building permit prior <br /> to completing renovations, the Petitioner is now required to obtain ZBA approval for any <br /> renovations made on the subject property. The property consists of 4.5 acres bordering <br /> Mashpee Pond. Due to their growing family, the Petitioner is looking to expand one of <br /> the three pre-existing, non-conforming structures on the property. Plans call for <br /> renovations to the first floor, removal of the roof and construction of a second floor. <br /> There will be no increase in the footprint. <br /> The Board of Health has approved plans for a new leaching facility to <br /> accommodate a five-bedroom dwelling. The existing cesspool, which is located in close <br /> proximity to Mashpee Pond, will be replaced with a new Title 5 septic system. <br /> The Conservation Commission has approved the proposal. The Order of <br /> Conditions is contingent upon comment from Natural Heritage and Endangered Species. <br /> Board Member Ronald S. Bonvie said that he was unable to find the property and <br /> suggested installation of a street sign.
