McGoldrick <br /> Petitioner: Peter and Linda Connly <br /> SP-2012-35 <br /> 172 Waterway Certificate of Title#: 122288 <br /> Map 111 Parcel 90 Land Court Lot#: 85 <br /> Mashpee, MA 02649 Plan#: 11408-23 <br /> A Petition was filed on July 2, 2012 by Petitioners, Peter and Linda Connly, <br /> requesting a Special Permit under Section 174-20 of the Zoning By-laws to allow for <br /> replacement of a non-conforming structure destroyed by fire, flood, lightning, wind or <br /> otherwise on property located in an R-3 zoning district at 172 Waterway(Map 111 Parcel <br /> 90) Mashpee, MA. Owner of record: Janice A. McGoldrick. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on July 6, and July 13, 2012, <br /> a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on July 25, <br /> and August 8, 2012. The following members of the Board were present and acting <br /> throughout: Board Members Jonathan D. Furbush, William A. Blaisdell, James Reiffarth, <br /> Ronald S. Bonvie and Judith M. Horton. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> At the July 25, 2012 Public Hearings, Attorney Kirrane represented the Petition <br /> and stated that plans call for demolition of the existing deteriorating dwelling on the <br /> subject property. It will be replaced with construction of a four-bedroom, two-story <br /> dwelling. The lot is non-conforming with only 100 feet of frontage on Waterway. The <br /> existing dwelling does not conform to current front setback requirements. It encroaches <br /> into the setback to water and wetlands. Plans to remove the lawn and replace it with <br /> environmentally-friendly landscaping is a significant improvement to the site conditions. <br /> and reduces the impact on the surrounding properties and wetlands. <br /> The Conservation Commission approved the proposal on July 12, 2012 and issued <br /> an Order of Conditions on July 23, 2012. <br /> A Title 5 septic system was installed in 1994 on the subject property. The Board <br /> of Health is restricting the proposal to four bedrooms. <br /> The Architectural Review Committee of New Seabury has approved the proposal. <br />
