Town o,f`Mashpee y( M 16 Great)%ck&ad A; rth - n,v�,�E�:+�, tYlashpee,?Ylassaclarisetts 02e49 MASHPEE ZONING BOARD OF APPEALS DECISION FOR GRANT OF A VARIANCE V-2012-3 8 Peter Costill Registry of Deeds Title Reference: 37 Monomoscoy Road West Book 25550 Page 176 Map 114 Parcel 11 Mashpee, MA 02649 A Petition was filed on July 5, 2012 by Peter Costill requesting a Variance from Sections 174-31 and 174-33 of the Zoning By-laws to vary the land space requirements and the setback requirements from water and wetlands to allow for construction of a boathouse on property located in an R-3 zoning district at 37 Monomoscoy Road West (Map 114 Parcel 11) Mashpee, MA. Petitioner was unable to commence project and Variance V-2011-13 has lapsed. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on August 3, and August 10, 2012, a copy of which is attached hereto and made a part hereof. Public Hearings were held on the Petition at the Mashpee Town Hall on August 22, 2012. The following members of the Board were present and acting throughout: Board Members Jonathan D. Furbush, William A. Blaisdell, James Reiffarth, Ronald S. Bonvie, and Judith M. Horton. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. Mr. Costill represented his Petition and stated that his 2011 ZBA Variance has lapsed due to financial hardship. He stated that he is saving money in order to proceed with the proposed construction. Mr. Costill said that he has not made any changes to the plan. The Conservation Commission has approved the project. No comments were received from abutters. GENERAL FINDINGS The subject property is located at 37 Monomoscoy Road West and consists of 5,635 square feet of land.
