Town o,f`Mashpee <br /> y( M <br /> 16 Great)%ck&ad A; rth <br /> - <br /> n,v�,�E�:+�, tYlashpee,?Ylassaclarisetts 02e49 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR GRANT OF A VARIANCE <br /> V-2012-3 8 <br /> Peter Costill Registry of Deeds Title Reference: <br /> 37 Monomoscoy Road West Book 25550 Page 176 <br /> Map 114 Parcel 11 <br /> Mashpee, MA 02649 <br /> A Petition was filed on July 5, 2012 by Peter Costill requesting a Variance from <br /> Sections 174-31 and 174-33 of the Zoning By-laws to vary the land space requirements <br /> and the setback requirements from water and wetlands to allow for construction of a <br /> boathouse on property located in an R-3 zoning district at 37 Monomoscoy Road West <br /> (Map 114 Parcel 11) Mashpee, MA. Petitioner was unable to commence project and <br /> Variance V-2011-13 has lapsed. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on August 3, and August 10, <br /> 2012, a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on August <br /> 22, 2012. The following members of the Board were present and acting throughout: <br /> Board Members Jonathan D. Furbush, William A. Blaisdell, James Reiffarth, Ronald S. <br /> Bonvie, and Judith M. Horton. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. Costill represented his Petition and stated that his 2011 ZBA Variance has <br /> lapsed due to financial hardship. He stated that he is saving money in order to proceed <br /> with the proposed construction. Mr. Costill said that he has not made any changes to the <br /> plan. <br /> The Conservation Commission has approved the project. <br /> No comments were received from abutters. <br /> GENERAL FINDINGS <br /> The subject property is located at 37 Monomoscoy Road West and consists of <br /> 5,635 square feet of land. <br />
