Mash Planning Board <br /> Minutes of Meeting <br /> November 3, 2010 at 7 p.m. <br /> Selectmen's fleeting Roorr, 1lashpee Town Hall <br /> CALL TO ORDER <br /> The Town of Mashpee Planning Board meeting was opened with a quormn in the Selectmen's Meeting Room at <br /> M s pee'Town l by the Chairman at TOO oo p.m. on Wednesday, November 3, 2010. <br /> Planning Board Members Present: C Mary w ygan, Vice-Chair Dennis B l rini, Joe Mullin, George <br /> Petersen and David I ooharian <br /> Also Present: Mchael Richardson-Seleaman Liaison and Tom Fula-Town Planner <br /> APPROVAL of MINUTES <br /> MOTION: Mr.Bad rini made a motion to accept the October e meeting minutes as written. Mr. <br /> Mullin seconded the motion. All voted unanimously. <br /> The October 2&minutes were recently received and will be tabled for discussion at the next meeting. <br /> PUBLIC HEARING <br /> 7:10 Applicant: Mark Lima Ashers Heights Homeowners <br /> Location: Ashers Heights Subdivision <br /> Request: Modification of serial permit to eliminate water quality monitoring program and Bruit <br /> n lawn size. <br /> Being that the appointed time arrived, the Chair opened the public hearing and read for the record the public <br /> hearing notice, Mark Lima addressed the Board on behalf of the Asher Heights Subdivision. Mr. Liana read for <br /> the record a letter highlighting the numns for their request for a special permit modification. <br /> Mr. Bai arini questioned who manages the catch basin and Mr. Fudala responded that since the Town took the <br /> roads, the'Town ritains the etch basin. Nor. Fudala added that, a number of years ago, the developer did not <br /> pay takes and the cluster subdivision's open space was taken by the Town and transferred to the Conservation <br /> Commission. Regarding the water quality bylaw, llrlr. Fudala explained that developers were required to install <br /> monitoring wells with a long term monitoring program and demonstrate the impact of nitrogen levels in the bay <br /> and shove how increased nitrogen levels in the bray would be nftfigated. The developer for Ashers Path chose to <br /> complete initial testing during the 10s and reports were greeted, including two reports from the <br /> Association. At the time, concern was expressed about possible contamYnation in the area from the Town's <br /> septage lagoons located nearby. Mr. Fudala stated that many of the subdivisions subject to the bylaw have not <br /> been maintaining the monitoring of their wells. Mr. Fudala added that easements were given to the Town in <br /> order to have access to the wells to meawre water quality and the wells are believed to be located on <br /> Conservation land. fir. Fudalaswed that long tern monitoring is no longer needed since the Massachusetts <br /> Estuary Project MEP is now monitoring the bays. The wells have been used for studies in town. her. Fudala <br /> noted that the only subdivisions co to monitor their wells some° fud consistently are forth Market <br /> Street, South Cape Mil la a and Windchime Point Condonfinhms. Mr. Fudala confirmed that it-nay not be <br /> unreasonable to waiver the well monitoring program but suggested greater concern with the 1,000 square foot <br /> awn mover. <br /> 1 <br />
